1. Ariana Nexus Does Not Sell or Share Your Personal Information

1.1. Ariana Nexus does not sell your Personal Information. As of the Effective Date of this notice, Ariana Nexus, LLC does not sell and has never sold the Personal Information of consumers, as the term "sell" is defined under the CCPA/CPRA (Cal. Civ. Code § 1798.140(ad)), the Virginia Consumer Data Protection Act (Va. Code § 59.1-575), the Delaware Personal Data Privacy Act (6 Del. Code Ch. 12D), the Colorado Privacy Act (C.R.S. § 6-1-1301 et seq.), the Connecticut Data Privacy Act (Conn. Gen. Stat. § 42-515 et seq.), the Oregon Consumer Privacy Act (ORS § 646A.570 et seq.), the Texas Data Privacy and Security Act (Tex. Bus. & Com. Code § 541.001 et seq.), or any other applicable state or federal privacy law.

1.2. Ariana Nexus does not share your Personal Information for cross-context behavioral advertising. As of the Effective Date, Ariana Nexus does not share and has never shared the Personal Information of consumers for cross-context behavioral advertising, as the term "share" is defined under the CCPA/CPRA (Cal. Civ. Code § 1798.140(ah)).

1.3. Ariana Nexus does not engage in targeted advertising using your Personal Information. Ariana Nexus does not process Personal Information for the purpose of targeted advertising, as that term is defined under the VCDPA, Delaware PDPA, Colorado Privacy Act, Connecticut Data Privacy Act, Oregon Consumer Privacy Act, Texas Data Privacy and Security Act, or any other applicable state privacy law.

1.4. Ariana Nexus does not use or disclose Sensitive Personal Information for purposes beyond those authorized under CCPA/CPRA Section 1798.121. To the extent Ariana Nexus collects Sensitive Personal Information (as defined under Cal. Civ. Code § 1798.140(ae)), such information is used only for the purposes expressly authorized under Cal. Civ. Code § 1798.121(a), including: performing services reasonably expected by the consumer, ensuring security and integrity, short-term transient use, performing services on behalf of Ariana Nexus, and activities to verify or maintain the quality of services.

2. Why This Page Exists

2.1. The CCPA/CPRA requires businesses that sell or share Personal Information to provide a clear and conspicuous link titled "Do Not Sell or Share My Personal Information" on their website. While Ariana Nexus does not sell or share Personal Information and is therefore not required to provide this page, we publish this notice voluntarily as a commitment to transparency and to ensure that consumers can exercise their rights without confusion.

2.2. Multiple U.S. state privacy laws — including those in California, Virginia, Delaware, Colorado, Connecticut, Oregon, Texas, Montana, Iowa, Indiana, Tennessee, New Jersey, New Hampshire, Nebraska, Kentucky, Maryland, Minnesota, and additional states with enacted or pending privacy legislation — provide consumers with the right to opt out of the sale of their Personal Information, targeted advertising, and certain profiling activities. This page addresses all such opt-out rights in a single location.

3. Your Right to Opt Out

3.1. Even though Ariana Nexus does not currently sell, share, or use Personal Information for targeted advertising, you have the right to opt out of such activities if Ariana Nexus's practices change in the future.

3.2. If Ariana Nexus's practices change: Should Ariana Nexus begin selling or sharing Personal Information, or begin processing Personal Information for targeted advertising, at any time in the future, Ariana Nexus will: (a) update this page and the Privacy Policy to reflect the change; (b) provide a functional opt-out mechanism on this page; (c) honor all opt-out requests received through such mechanism; and (d) provide at least thirty (30) days' advance notice of such change through the Website, to the extent required by applicable law.

3.3. Preemptive Opt-Out Request: If you wish to submit a preemptive opt-out request — indicating that you do not consent to any future sale, sharing, or use of your Personal Information for targeted advertising — you may do so by contacting us at:

Ariana Nexus will record your preemptive opt-out request and will honor it if and when any change in practices occurs.

4. Global Privacy Control (GPC)

4.1. Ariana Nexus recognizes and honors Global Privacy Control (GPC) signals transmitted by your browser or device, as required by the CCPA/CPRA, the Colorado Privacy Act (CPA), the Connecticut Data Privacy Act (CTDPA), the Texas Data Privacy and Security Act (TDPSA), the Montana Consumer Data Privacy Act (MCDPA), the Delaware Personal Data Privacy Act (DPDPA), and other applicable state privacy laws that mandate recognition of universal opt-out mechanisms.

4.2. When a GPC signal is detected, Ariana Nexus will treat it as a valid request to opt out of the sale or sharing of Personal Information and targeted advertising, to the extent applicable. Because Ariana Nexus does not currently sell, share, or use Personal Information for targeted advertising, the practical effect of a GPC signal is that non-essential cookies and tracking technologies will not be placed on your device, consistent with our Cookie Policy.

4.3. You may enable GPC in supported browsers and extensions. For more information about GPC, visit globalprivacycontrol.org.

4.4. Disclaimer: Ariana Nexus implements commercially reasonable technical measures to detect and honor GPC signals. However, due to variations in browser implementations, signal transmission methods, and technical standards, Ariana Nexus cannot guarantee that every GPC signal will be detected or processed without delay. Ariana Nexus shall not be liable for any failure to detect a GPC signal that is caused by browser misconfiguration, network interference, technical limitations, or circumstances beyond Ariana Nexus's reasonable control. 5. Do Not Track (DNT)

5.1. Some web browsers offer a "Do Not Track" (DNT) feature that sends a signal to websites indicating that the user does not wish to be tracked. The World Wide Web Consortium (W3C) discontinued the DNT specification, and there is no universally accepted standard for how websites should respond to DNT signals.

5.2. Ariana Nexus does not currently respond to DNT signals. Global Privacy Control (GPC), described in Section 4, is the emerging industry and legal standard for browser-based opt-out signaling and is honored by Ariana Nexus as described therein.

6. Categories of Personal Information

6.1. For transparency and in compliance with the CCPA/CPRA disclosure requirements, the following table summarizes the categories of Personal Information that Ariana Nexus collects through the Website, whether each category has been sold or shared, and the business purpose for collection:

6.2. Ariana Nexus does not collect the following categories of Personal Information through the Website: Social Security numbers, driver's license numbers, financial account information, Protected Health Information, biometric data, education records, or Sensitive Personal Information (as defined under the CCPA/CPRA), except to the extent that professional or employment-related information provided voluntarily through contact forms may fall within the CCPA definition of "professional or employment-related information."

7. Right to Limit Use of Sensitive Personal Information

7.1. Under the CCPA/CPRA, consumers have the right to direct a business to limit the use and disclosure of Sensitive Personal Information to purposes authorized under Cal. Civ. Code § 1798.121(a).

7.2. Ariana Nexus does not use or disclose Sensitive Personal Information for purposes beyond those expressly authorized under Section 1798.121(a). Therefore, no "Limit the Use of My Sensitive Personal Information" mechanism is required. However, if you believe that Ariana Nexus is processing your Sensitive Personal Information in a manner not authorized by law, please contact us at privacy@ariananexus.com or (607) 697-5250, and we will promptly investigate and address your concern.

8. Authorized Agent Requests

8.1. Under the CCPA/CPRA and certain other state privacy laws, you may designate an authorized agent to submit an opt-out request on your behalf. To designate an authorized agent, you must provide Ariana Nexus with:

8.2. Ariana Nexus reserves the right to verify the identity of both the consumer and the authorized agent before processing any request. Ariana Nexus may deny a request from an agent that does not provide sufficient proof of authorization.

9. Non-Discrimination

9.1. Ariana Nexus will not discriminate against you for exercising any of your rights under the CCPA/CPRA or any other applicable privacy law. Specifically, Ariana Nexus will not:

10. Financial Incentives

10.1. Ariana Nexus does not offer any financial incentive or price or service difference in exchange for the retention, sale, sharing, or deletion of Personal Information.

10.2. If Ariana Nexus introduces any financial incentive program in the future, this page and the Privacy Policy will be updated to include the material terms of such program, the method for opting in, and the method for opting out, in compliance with Cal. Civ. Code § 1798.125.

11. Children's Information

11.1. Ariana Nexus does not knowingly collect Personal Information from consumers under the age of sixteen (16) through the Website.

11.2. Ariana Nexus does not sell or share the Personal Information of consumers under the age of sixteen (16). Under the CCPA/CPRA, the sale or sharing of Personal Information of consumers under sixteen (16) requires affirmative authorization (opt-in consent): from the consumer directly if aged thirteen (13) to fifteen (15), or from a parent or guardian if under thirteen (13). Because Ariana Nexus does not sell or share any consumer's Personal Information, this requirement is not triggered. If Ariana Nexus's practices change, we will implement the required affirmative authorization mechanisms before any sale or sharing of a minor's Personal Information occurs.

11.3. Delaware DPDPA Minors Provision: Under the Delaware Personal Data Privacy Act (6 Del. Code Ch. 12D), Ariana Nexus does not process Personal Data of known minors aged 13 to 17 for targeted advertising, sale, or profiling without the minor's consent. Ariana Nexus does not engage in the sale of Personal Data of any known minor under 18.

12. Verification Process

12.1. When Ariana Nexus receives a request to opt out of the sale or sharing of Personal Information, or any other privacy rights request, Ariana Nexus will verify the identity of the requestor before processing the request.

12.2. Verification may require the requestor to provide information that matches Ariana Nexus's records, such as name, email address, or other identifying information previously submitted to Ariana Nexus.

12.3. Ariana Nexus will not require the requestor to create an account to submit or verify a request. Ariana Nexus will use the information provided for verification solely for the purpose of verifying the requestor's identity and will not use it for any other purpose.

12.4. If Ariana Nexus cannot reasonably verify the identity of the requestor, Ariana Nexus will inform the requestor and explain the basis for the denial. The requestor may appeal the denial by contacting privacy@ariananexus.com with the subject line "Privacy Rights Appeal."

13. Response Timing

13.1. Ariana Nexus will process opt-out requests as promptly as technically feasible, and in no event later than fifteen (15) business days after receipt of the request, as required by the CCPA/CPRA (Cal. Civ. Code § 1798.135(e)).

13.2. For other privacy rights requests (access, deletion, correction), Ariana Nexus will respond within the timeframes specified in the Privacy Policy, Section 10.5.

14. Limitation of Liability

14.1. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ARIANA NEXUS, ITS OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, AGENTS, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATED TO THIS PAGE, THE OPT-OUT PROCESS, OR THE EXERCISE OF ANY PRIVACY RIGHT, INCLUDING BUT NOT LIMITED TO: DAMAGES ARISING FROM TECHNICAL DELAYS IN PROCESSING OPT-OUT REQUESTS; DAMAGES ARISING FROM THE ACTIONS OR DATA PRACTICES OF THIRD PARTIES; OR DAMAGES ARISING FROM YOUR PROVISION OF INACCURATE IDENTIFICATION INFORMATION.

14.2. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ARIANA NEXUS'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THIS PAGE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).

14.3. NOTHING IN THIS PAGE SHALL LIMIT OR EXCLUDE ARIANA NEXUS'S LIABILITY FOR: (A) FRAUD OR FRAUDULENT MISREPRESENTATION; (B) DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE; OR (C) ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED BY APPLICABLE LAW, INCLUDING BUT NOT LIMITED TO LIABILITY UNDER THE UK UNFAIR CONTRACT TERMS ACT 1977, THE UK CONSUMER RIGHTS ACT 2015, OR GDPR.

14.4. THE LIMITATIONS IN THIS SECTION APPLY TO THE FULLEST EXTENT PERMITTED BY LAW. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, ARIANA NEXUS'S LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

15. Dispute Resolution

15.1. Any dispute arising out of or relating to this page, the opt-out process, or the exercise of any privacy right shall be subject to the dispute resolution provisions set forth in the Terms of Use, Section 18, including the binding arbitration clause, class action waiver, and one-year time limitation on claims.

15.2. Before initiating any formal proceeding, you agree to contact Ariana Nexus at privacy@ariananexus.com or +1 (202) 771-0224 to attempt informal resolution.

15.3. Nothing in this page prevents you from filing a complaint with the applicable regulatory authority, including:

Ariana Nexus cooperates with regulatory authorities in good faith and will respond promptly to any regulatory inquiry.

16. Changes to This Page

16.1. Ariana Nexus reserves the right to update this page at any time, at its sole discretion. If Ariana Nexus begins selling or sharing Personal Information or processing Personal Information for targeted advertising, this page will be updated to reflect the change and to provide a functional opt-out mechanism.

16.2. When changes are made, the "Last Revised" date at the top of this page will be updated. Your continued use of the Website after changes are posted constitutes your acknowledgment of those changes.
