1. How to Manage Your Privacy Preferences

1.1. Ariana Nexus uses Consent Pro by Finsweet, a GDPR- and CCPA-compliant cookie consent management platform integrated into the Website through our Webflow hosting environment. This tool allows you to manage your preferences for cookies and tracking technologies directly on the Website.

1.2. Accessing the Consent Manager: You may access or modify your privacy preferences at any time by:

If you close the consent banner without making a selection, only Essentials cookies are placed. This is consistent with GDPR requirements for prior, informed, and affirmative consent.

2. Cookie Categories and Your Choices

The consent manager organizes cookies and tracking technologies into four categories. The following describes each category, what it controls, and the effect of your choice:

2.1. Essentials — Always Active

Status: Always On. Cannot be disabled.

What it does: Essentials cookies are strictly necessary for the Website to function. They enable core functionality including page navigation, session management, security (CSRF protection, bot detection), load balancing, and storage of your consent preferences. These cookies do not collect personally identifiable information for marketing or analytics purposes.

Why it cannot be disabled: Without Essentials cookies, the Website cannot operate. Disabling them would prevent page loading, form submissions, and security protections.

Legal basis (GDPR): Legitimate interest under Article 6(1)(f) GDPR. Exempted from consent requirement under Article 5(3) of the ePrivacy Directive (Directive 2002/58/EC) as strictly necessary cookies.

Legal basis (CCPA/CPRA): These cookies are necessary to provide a service you have requested and do not constitute a "sale" or "sharing" of Personal Information.

Examples: Session identifiers, consent preference storage, Cloudflare security tokens, Webflow load balancer cookies.

2.2. Analytics — Your Choice

Status: Off by default. Activated only with your consent.

What it does: Analytics cookies measure how visitors interact with the Website — which pages are visited, how long visitors spend on each page, where visitors arrive from, and where errors occur. This data helps Ariana Nexus understand Website usage patterns and improve the user experience. Analytics data is collected in aggregate and is anonymized where technically feasible.

If you enable Analytics: Ariana Nexus and its analytics providers (currently Google Analytics 4 (GA4), which does not log or store full IP addresses by default) will place analytics cookies on your device and collect usage data as described above.

If you disable Analytics (or do not enable): No analytics cookies will be placed. Ariana Nexus will not collect usage data from your visit. Your experience on the Website will not be affected.

Legal basis (GDPR): Consent under Article 6(1)(a) GDPR.

Legal basis (CCPA/CPRA): Ariana Nexus does not sell or share analytics data. Analytics data is used solely for Website improvement.

Examples: Google Analytics 4 (_ga, _ga_[ID], _gid).

2.3. Marketing — Your Choice

Status: Off by default. Activated only with your consent.

What it does: Marketing cookies are used to track visitors across websites and display advertisements or content that is relevant and engaging for the individual user.

Ariana Nexus's current use: As of the Effective Date of this page, Ariana Nexus does not actively use marketing cookies or engage in targeted advertising. The Marketing category is present in the consent manager to provide a complete and standards-compliant consent framework and to support future functionality if Ariana Nexus decides to implement marketing or remarketing technologies. If and when marketing cookies are activated, this page and the Cookie Policy will be updated to identify the specific cookies, their providers, and their purposes.

If you enable Marketing: If marketing cookies are activated in the future, enabling this category will allow Ariana Nexus and its marketing partners to place cookies on your device for the purpose of delivering relevant content and measuring campaign effectiveness.

If you disable Marketing (or do not enable): No marketing cookies will be placed. You will not receive targeted advertising from Ariana Nexus through cookie-based tracking. Your experience on the Website will not be affected.

Legal basis (GDPR): Consent under Article 6(1)(a) GDPR. Marketing cookies will never be placed without your prior, affirmative consent.

Legal basis (CCPA/CPRA): If marketing cookies are activated in the future and constitute a "sale" or "sharing" of Personal Information, Ariana Nexus will honor all opt-out requests, recognize GPC signals, and update the Do Not Sell or Share My Personal Information page accordingly.

Examples: None currently active. Future integrations may include LinkedIn Insight Tag, Meta Pixel, Google Ads remarketing, or similar technologies. This section will be updated if and when specific marketing cookies are deployed.

2.4. Personalization — Your Choice

Status: Off by default. Activated only with your consent.

What it does: Personalization cookies remember your preferences and settings to provide enhanced functionality and a tailored experience. This may include remembering your language selection, region preference, display settings, or previously completed form fields.

If you enable Personalization: Ariana Nexus will place personalization cookies on your device to remember your preferences across visits.

If you disable Personalization (or do not enable): No personalization cookies will be placed. You may need to re-enter your preferences on each visit. Core Website functionality will not be affected.

Legal basis (GDPR): Consent under Article 6(1)(a) GDPR.

Legal basis (CCPA/CPRA): Personalization data is not sold or shared. It is used solely to improve your experience on the Website.

Examples: Language preference, region preference, display settings.

4. Global Privacy Control (GPC) and Do Not Track (DNT)

4.1. Global Privacy Control (GPC): Ariana Nexus recognizes and honors GPC signals transmitted by your browser or device, as required by the CCPA/CPRA, the Colorado Privacy Act (CPA), the Connecticut Data Privacy Act (CTDPA), the Texas Data Privacy and Security Act (TDPSA), the Montana Consumer Data Privacy Act (MCDPA), the Delaware Personal Data Privacy Act (DPDPA), and other applicable state privacy laws that mandate recognition of universal opt-out mechanisms. When a GPC signal is detected:

4.3. Do Not Track (DNT): The World Wide Web Consortium (W3C) discontinued the DNT specification, and there is no universally accepted standard for how websites should respond to DNT signals. Ariana Nexus does not currently respond to DNT signals. Global Privacy Control (GPC), described in Section 4.1, is the emerging industry and legal standard for browser-based opt-out signaling. For more information, see our Cookie Policy, Section 5.2.

5.4. Do Not Sell or Share

6. How Ariana Nexus Processes Your Choices

6.1. Immediate Effect: When you make a selection through the consent manager (Accept All, Reject All, or Save Preferences), your choice takes effect immediately for subsequent page loads and interactions. Cookies that have already been placed on your device prior to your selection may persist until they expire or until you clear your browser cookies.

6.2. Consent Storage: Your consent preference is stored in an Essentials cookie on your device so that the Website does not need to ask for your consent on every page load. This consent cookie is retained for twelve (12) months, after which the consent banner will reappear to request your updated preferences.

6.3. Consent Records: Ariana Nexus maintains server-side records of consent selections, including the date and time of consent, the categories consented to, and the version of the consent framework in effect at the time of consent, as required by GDPR Article 7(1) and other applicable laws.

6.4. Revocation: You may revoke or change your consent at any time by accessing the consent manager through the footer link or by clearing your cookies. Revocation does not affect the lawfulness of processing that occurred before revocation.

6.5. Disclaimer: Ariana Nexus implements commercially reasonable technical measures through Finsweet Consent Pro to honor your privacy preferences. However, due to the nature of internet technology, caching, CDN behavior, and third-party service integrations, there may be a brief technical delay between your selection and the full implementation of that selection across all systems and page elements. Ariana Nexus shall not be liable for any cookies placed or data collected during such delay, or for any failure of third-party scripts to respect your consent selection that is outside of Ariana Nexus's reasonable technical control.

7. Third-Party Services and Your Choices

7.1. The Website integrates services from third parties whose privacy practices are governed by their own policies:

When you disable a cookie category through the consent manager, Ariana Nexus suppresses the loading of the associated third-party scripts to the extent technically feasible within the Webflow/Finsweet environment. However, some third-party services may have independent mechanisms for tracking that operate outside of Ariana Nexus's cookie consent framework.

Disclaimer: Ariana Nexus does not control and is not responsible for the data collection practices, cookie placement, privacy policies, security measures, or compliance of any third-party service, regardless of whether that service is integrated into the Website. Ariana Nexus expressly disclaims all liability for any data collected, stored, processed, or disclosed by any third party, including data collected through mechanisms that bypass the consent manager. If you have concerns about a specific third-party service, you should review that service's privacy policy and contact them directly.

8. Consent for Specific Jurisdictions

8.1. European Economic Area (EEA) and United Kingdom

8.1.1. If you are located in the EEA or UK, the consent manager operates in accordance with the GDPR, UK GDPR, and ePrivacy Directive. Non-essential cookies are not placed until you provide prior, affirmative, informed consent. Consent is granular (by category), freely given, and revocable at any time.

8.1.2. Ariana Nexus does not treat scrolling, continued browsing, or closing the consent banner as consent. Only an affirmative click on "Accept All" or a category-specific toggle constitutes valid consent.

8.2. California

8.2.1. If you are a California resident, Ariana Nexus honors your rights under the CCPA/CPRA, including the right to opt out of the sale or sharing of Personal Information. Because Ariana Nexus does not currently sell or share Personal Information, the consent manager serves as an additional transparency and control mechanism. GPC signals are honored as described in Section 4.

8.3. Virginia, Delaware, Colorado, Connecticut, Oregon, Texas, Montana, Iowa, Indiana, Tennessee, New Jersey, New Hampshire, Nebraska, Kentucky, Maryland, Minnesota, and Other States

8.3.1. Ariana Nexus provides the consent manager and this page as a unified mechanism for consumers in all U.S. states with enacted privacy laws to exercise their opt-out rights regarding targeted advertising, sale of Personal Information, and profiling. This includes, but is not limited to, the VCDPA, Delaware PDPA (6 Del. Code Ch. 12D), CPA, CTDPA, OCPA, TDPSA, MCDPA, ICDPA, IDPA, TIPA, NJDPA, NHPA, NDPA, KCDPA, MODPA, and MCDPA. For the full list of state laws covered and their statutory citations, see our Do Not Sell or Share My Personal Information page, Section 19.

9. Children

9.1. The Website is not directed to children under the age of thirteen (13). The consent manager is designed for use by adults and individuals above the applicable age of majority.

9.2. Ariana Nexus does not knowingly collect Personal Information from children under 13 through cookies or the consent manager, in accordance with the Children's Online Privacy Protection Act (COPPA, 15 U.S.C. § 6501 et seq.) and the FTC's COPPA Rule (16 CFR Part 312), as amended by the January 2025 Final Rule. If Ariana Nexus becomes aware that cookies have collected data from a child under 13 without verified parental consent, the data will be deleted promptly.

9.3. Delaware DPDPA Minors Provision: Under the Delaware Personal Data Privacy Act (6 Del. Code Ch. 12D), Ariana Nexus does not use cookies or tracking technologies to process Personal Data of known minors aged 13 to 17 for targeted advertising, sale, or profiling without the minor's consent.

10. Limitation of Liability

10.1. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ARIANA NEXUS, ITS OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, AGENTS, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATED TO:

10.2. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ARIANA NEXUS'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THIS PAGE OR THE CONSENT MANAGER SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).

10.3. ARIANA NEXUS PROVIDES THE CONSENT MANAGER "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. ARIANA NEXUS DOES NOT WARRANT THAT THE CONSENT MANAGER WILL FUNCTION WITHOUT INTERRUPTION OR ERROR, THAT IT WILL BE COMPATIBLE WITH ALL BROWSERS OR DEVICES, OR THAT IT WILL SUCCESSFULLY BLOCK ALL NON-ESSENTIAL COOKIES OR TRACKING TECHNOLOGIES IN ALL CIRCUMSTANCES.

10.4. THE LIMITATIONS IN THIS SECTION APPLY TO THE FULLEST EXTENT PERMITTED BY LAW. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, ARIANA NEXUS'S LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

10.5. Nothing in this page shall limit or exclude Ariana Nexus's liability for: (a) fraud or fraudulent misrepresentation; (b) death or personal injury caused by negligence; or (c) any other liability that cannot be excluded or limited by applicable law, including but not limited to liability under the UK Unfair Contract Terms Act 1977, the UK Consumer Rights Act 2015, or GDPR.

11. Dispute Resolution

11.1. Any dispute arising out of or relating to this page, the consent manager, or your privacy choices shall be subject to the dispute resolution provisions set forth in the Terms of Use, Section 18, including the binding arbitration clause, class action waiver, and one-year time limitation on claims.

11.2. Before initiating any formal proceeding, you agree to contact Ariana Nexus at privacy@ariananexus.com or +1 (202) 771-0224 to attempt informal resolution.

12. Changes to This Page

12.1. Ariana Nexus reserves the right to update this page at any time. Changes to cookie categories, third-party integrations, or the consent framework may result in the consent banner being re-displayed to obtain your updated preferences.

12.2. When changes are made, the "Last Revised" date will be updated. Your continued use of the Website constitutes your acknowledgment of any changes.
