1. Our Commitment

1.1. Ariana Nexus, LLC ("Ariana Nexus," "we," "us," or "our") is committed to ensuring that ariananexus.com and any associated digital properties (collectively, the "Website") are accessible to all individuals, including individuals with disabilities, in accordance with applicable accessibility laws, regulations, and standards.

1.2. Accessibility is an ongoing effort. Ariana Nexus continuously works to improve the accessibility of the Website and to ensure that our digital experiences are inclusive and usable by the widest possible audience. We recognize that accessibility standards evolve, that technologies change, and that full compliance is a continuous process rather than a fixed state. We are committed to that process.

1.3. As an institutional orchestration firm that serves healthcare systems, government agencies, AI platforms, and research institutions — and that specializes in serving institutions working with Afghan diaspora communities — we understand that equitable access is not a compliance checkbox but a core operational principle.

2. Accessibility Standards

2.1. Target Standard

2.1.1. Ariana Nexus targets conformance with the Web Content Accessibility Guidelines (WCAG) 2.2 Level AA, published by the World Wide Web Consortium (W3C) Web Accessibility Initiative (WAI). WCAG 2.2 Level AA is the internationally recognized benchmark for web accessibility and is referenced by the majority of accessibility laws and regulations worldwide.

2.1.2. WCAG 2.2 Level AA addresses accessibility across four principles:

2.2. Current Conformance Status

2.2.1. Ariana Nexus has conducted an internal accessibility review of the Website and is actively working toward full WCAG 2.2 Level AA conformance. As of the date of this Statement, we believe the Website partially conforms to WCAG 2.2 Level AA. "Partially conforms" means that some portions of the Website may not yet fully conform to all WCAG 2.2 Level AA success criteria.

2.2.2. Ariana Nexus is transparent about the current state of its accessibility conformance. We do not claim full conformance where known gaps exist. The specific areas where we are aware of potential non-conformance are identified in Section 4 of this Statement, along with our remediation plan.

2.3. Ongoing Assessment

2.3.1. Ariana Nexus conducts periodic accessibility assessments of the Website, including a combination of automated testing tools, manual evaluation, and, where feasible, testing with assistive technologies.

2.3.2. Ariana Nexus is evaluating the engagement of a qualified third-party accessibility auditor to conduct a formal WCAG 2.2 Level AA conformance evaluation. The results of any such audit will be incorporated into our remediation roadmap, and this Statement will be updated accordingly.

3. Applicable Laws and Regulations

3.1. Ariana Nexus's accessibility efforts are informed by the following laws, regulations, and standards. This Statement is designed to address our obligations under each to the extent applicable:

3.2. United States

Americans with Disabilities Act (ADA) (42 U.S.C. § 12101 et seq.): Title III of the ADA prohibits discrimination on the basis of disability in places of public accommodation. The Department of Justice has clarified that the ADA applies to websites of entities covered under Title III. Ariana Nexus endeavors to ensure that the Website does not discriminate against individuals with disabilities.

Section 508 of the Rehabilitation Act (29 U.S.C. § 794d): Section 508 requires federal agencies to make their electronic and information technology accessible to people with disabilities. While Ariana Nexus is not a federal agency, it positions itself to serve federal government clients and therefore aligns the Website with Section 508 standards. The current ICT Standards and Guidelines (revised January 2017, effective January 2018) incorporate WCAG 2.0 Level A and AA success criteria. Ariana Nexus targets WCAG 2.2 Level AA, which exceeds the current Section 508 requirements.

DOJ ADA Title II Web Accessibility Rule (April 24, 2024): The Department of Justice finalized a rule under ADA Title II requiring state and local government websites and mobile applications to meet WCAG 2.1 Level AA. Compliance deadlines begin April 24, 2026. While Ariana Nexus is not a state or local government entity, this rule establishes a significant regulatory benchmark. Ariana Nexus monitors this rule and the DOJ's announced intent (September 2025) to issue an NPRM reconsidering certain compliance costs. Ariana Nexus's target of WCAG 2.2 Level AA exceeds the WCAG 2.1 Level AA standard adopted by this rule.

Section 504 of the Rehabilitation Act (29 U.S.C. § 794): Section 504 prohibits discrimination on the basis of disability in programs and activities receiving federal financial assistance. Ariana Nexus is aware of this obligation and designs its digital properties accordingly.

State Accessibility Laws: Various U.S. states have enacted or are considering digital accessibility requirements, including California (Unruh Civil Rights Act, Cal. Civ. Code § 51 et seq.), New York, and others. Ariana Nexus monitors state-level accessibility developments as part of its compliance program.

3.3. European Union

European Accessibility Act (EAA) (Directive (EU) 2019/882): The EAA establishes accessibility requirements for products and services, including certain digital services. Compliance obligations took effect on June 28, 2025, and EU Member States are now enforcing these requirements. Ariana Nexus monitors EAA enforcement and endeavors to align the Website with its provisions to the extent applicable to services offered to individuals in the EU, particularly as Ariana Nexus expands its European operations through planned offices in London and Berlin.

Web Accessibility Directive (Directive (EU) 2016/2102): This Directive requires public sector bodies in the EU to make their websites and mobile applications accessible. While Ariana Nexus is not a public sector body, alignment with this Directive supports our positioning to serve European government and institutional clients.

EN 301 549: The harmonized European standard for ICT accessibility, which references WCAG 2.1 Level AA. Ariana Nexus targets conformance with WCAG 2.2 Level AA, which exceeds the WCAG version referenced by EN 301 549.

3.4. United Kingdom

Equality Act 2010: The Equality Act prohibits discrimination against individuals with disabilities, including in the provision of services. The duty to make reasonable adjustments applies to digital services. Ariana Nexus endeavors to comply with the Equality Act to the extent applicable to services offered to individuals in the UK.

Public Sector Bodies (Websites and Mobile Applications) Accessibility Regulations 2018: While applicable to UK public sector bodies, Ariana Nexus aligns with these regulations to support its positioning for UK government and institutional clients.

3.5. International

UN Convention on the Rights of Persons with Disabilities (CRPD): Ariana Nexus supports the principles of the CRPD, including Article 9 (Accessibility) and Article 21 (Freedom of expression and access to information), and endeavors to apply these principles in the design and operation of the Website.

4. Known Limitations and Remediation Plan

7. Multilingual Accessibility

7.1. Ariana Nexus serves institutions working with Afghan diaspora communities across multiple countries and languages. We recognize that accessibility extends beyond technical compliance to include linguistic and cultural accessibility.

7.2. The Website is primarily presented in English. Ariana Nexus is developing multilingual content capabilities and evaluates the need for content in additional languages based on the communities we serve.

7.3. The Website's language is declared programmatically (using the HTML lang attribute) to enable assistive technologies to present content in the correct language context. Where content appears in languages other than the primary page language, language attributes are applied at the element level where technically feasible.

11.1. The Website integrates services and content from third parties, including Webflow (hosting), Cloudflare (CDN and security), Google Analytics (analytics), and other providers. Ariana Nexus selects third-party providers that support accessibility features where possible and advocates for improved accessibility in third-party components.

11.2. Disclaimer: Ariana Nexus does not control the development, design, coding, or accessibility compliance of third-party services, components, or content integrated into the Website. While Ariana Nexus makes commercially reasonable efforts to ensure that third-party integrations support accessibility, Ariana Nexus expressly disclaims all responsibility and liability for any accessibility barriers, failures, or non-conformance caused by or attributable to third-party services, components, content, or technologies. If you encounter an accessibility barrier in a third-party component, please notify us and we will work with the third-party provider to seek a resolution or provide an alternative means of access.

12. Limitation of Liability

12.1. ARIANA NEXUS IS COMMITTED TO ACCESSIBILITY AND MAKES COMMERCIALLY REASONABLE EFFORTS TO CONFORM THE WEBSITE TO WCAG 2.2 LEVEL AA. HOWEVER, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

Nothing in this Statement shall limit or exclude Ariana Nexus's liability for: (a) fraud or fraudulent misrepresentation; (b) death or personal injury caused by negligence; or (c) any other liability that cannot be excluded or limited by applicable law, including but not limited to liability under the UK Unfair Contract Terms Act 1977, the UK Consumer Rights Act 2015, the UK Equality Act 2010, or GDPR.

Good Faith Commitment: This limitation of liability reflects the reality that full accessibility conformance is a continuous effort affected by evolving standards, third-party dependencies, and technical complexity — not a lack of commitment. Ariana Nexus invests in accessibility because it is the right thing to do, and we invite users who encounter barriers to contact us so we can address them.

13. Dispute Resolution

13.1. Governing Law: This Accessibility Statement shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, United States, without regard to its conflict of laws principles.

13.2. Contact Before Legal Action: If you believe you have been discriminated against on the basis of disability in your access to the Website, we ask that you contact Ariana Nexus first at accessibility@ariananexus.com or (607) 697-5250 before pursuing any legal remedy. Ariana Nexus is committed to resolving accessibility concerns promptly and in good faith, and we believe that direct communication is the most effective and efficient means of addressing accessibility barriers.

13.3. Jurisdiction and Venue: To the extent any dispute related to this Statement is not resolved informally, such dispute shall be subject to the dispute resolution provisions set forth in our Terms of Use, Section 18, including the binding arbitration clause, class action waiver, and one-year time limitation on claims.

13.4. Regulatory Complaints: Nothing in this Statement prevents you from filing a complaint with the applicable regulatory authority, including:

14. Changes to This Statement

Ariana Nexus reserves the right to update this Accessibility Statement at any time, at its sole discretion, to reflect changes in our accessibility conformance status, remediation progress, applicable laws, or the standards we target. When we make changes, we will update the "Last Revised" date at the top of this Statement.

14.2. Your continued use of the Website after changes are posted constitutes your acceptance of the updated Statement.
