Global Privacy Control (GPC): Ariana Nexus recognizes and honors Global Privacy Control (GPC) signals as opt-out requests where required by applicable law, including under the CCPA/CPRA (California), the Colorado Privacy Act (CPA), the Connecticut Data Privacy Act (CTDPA), the Texas Data Privacy and Security Act (TDPSA), the Montana Consumer Data Privacy Act (MCDPA), the Delaware Personal Data Privacy Act (DPDPA), and other applicable state laws that mandate recognition of universal opt-out mechanisms. When a GPC signal is detected, Ariana Nexus will treat it as a valid request to opt out of the sale or sharing of Personal Information and will not place non-essential Cookies.

6. Compliance with Applicable Law

6.1. European Union — ePrivacy Directive and GDPR

6.1.1. Ariana Nexus complies with Article 5(3) of the ePrivacy Directive (Directive 2002/58/EC, as amended by Directive 2009/136/EC) and the GDPR (Regulation (EU) 2016/679) with respect to the use of Cookies on the Website.

6.1.2. Strictly Necessary Cookies are placed under the exemption provided by Article 5(3) of the ePrivacy Directive, which does not require consent for Cookies that are strictly necessary for the provision of a service explicitly requested by the user.

6.1.3. All non-essential Cookies (Analytics, Functional, and third-party Cookies) are placed only after the user has provided affirmative, informed, freely given, specific, and unambiguous consent in accordance with the GDPR.

6.1.4. Consent is obtained through a clear and prominent cookie consent banner that: (a) provides information about the categories of Cookies used and their purposes; (b) offers a genuine choice to accept or reject non-essential Cookies; (c) does not use pre-ticked boxes; (d) does not treat inaction or continued browsing as consent; and (e) allows granular consent by cookie category.

Regulatory Monitoring — CNIL Tracking Pixel Guidance: In June 2025, the French Data Protection Authority (CNIL) launched a public consultation on draft recommendations that would classify tracking pixels in emails as subject to ePrivacy Directive cookie consent requirements. Ariana Nexus is monitoring this guidance. If Ariana Nexus deploys email tracking pixels in the future, it will assess and comply with applicable consent requirements.

6.2. United Kingdom — PECR and UK GDPR

6.2.1. Ariana Nexus complies with the Privacy and Electronic Communications Regulations 2003 (PECR), as amended, and the UK GDPR with respect to the use of Cookies.

6.2.2. Ariana Nexus applies the same consent standards for UK users as for EEA users, consistent with the ICO's guidance on the use of cookies and similar technologies.

6.3. United States — CCPA/CPRA

6.3.1. Under the CCPA/CPRA (Cal. Civ. Code § 1798.100 et seq.), Ariana Nexus does not sell Personal Information collected through Cookies and does not share Personal Information collected through Cookies for cross-context behavioral advertising.

6.3.2. Ariana Nexus honors Global Privacy Control (GPC) signals as valid opt-out requests from California residents.

6.3.3. California residents may exercise their rights under the CCPA/CPRA as described in our Privacy Policy, Section 10.2.

6.4. Virginia — VCDPA

6.4.1. Ariana Nexus does not use Cookies for targeted advertising or for the sale of Personal Data, as those terms are defined under the VCDPA (Va. Code § 59.1-575 et seq.).

6.4.2. Virginia residents may exercise their rights under the VCDPA as described in our Privacy Policy, Section 10.3.

6.5. Delaware — DPDPA

6.5.1. Ariana Nexus does not use Cookies for targeted advertising or for the sale of Personal Data under the Delaware Personal Data Privacy Act (6 Del. Code Ch. 12D).

6.5.2. Delaware residents may exercise their rights under the Delaware PDPA as described in our Privacy Policy, Section 10.4.

6.6. Additional U.S. State Privacy Laws

6.6.1. Ariana Nexus does not use Cookies for targeted advertising or for the sale of Personal Data as those terms are defined under applicable U.S. state consumer privacy laws, including but not limited to the Colorado Privacy Act (CPA), Connecticut Data Privacy Act (CTDPA), Utah Consumer Privacy Act (UCPA), Oregon Consumer Privacy Act (OCPA), Texas Data Privacy and Security Act (TDPSA), Montana Consumer Data Privacy Act (MCDPA), and other state privacy laws that may apply. Residents of states with applicable consumer privacy laws may exercise their rights as described in our Privacy Policy, Section 10.5.

6.7. Other Jurisdictions

6.7.1. Ariana Nexus serves clients globally and monitors developments in data protection and cookie regulation in all jurisdictions where it operates or serves clients. Where local law imposes requirements beyond those described in this Policy, Ariana Nexus will comply with such requirements to the extent applicable.

6.7.2. Disclaimer: This Cookie Policy is designed to comply with the laws and regulations identified in this Section 6 as of the Effective Date. Laws and regulations regarding Cookies and similar technologies are subject to change. Ariana Nexus does not represent or warrant that this Policy complies with the laws of every jurisdiction worldwide. If you are located in a jurisdiction with specific cookie or tracking technology regulations not addressed in this Policy, you are responsible for determining whether your use of the Website is consistent with the laws of your jurisdiction. Ariana Nexus expressly disclaims liability for any non-compliance arising from the application of laws not specifically addressed in this Policy.

6.7.3. EU Digital Omnibus — Regulatory Monitoring Notice: On February 11, 2026, the European Commission formally withdrew the proposed ePrivacy Regulation. The EU Digital Omnibus package proposes to move certain cookie consent rules currently governed by the ePrivacy Directive (Article 5(3)) into the GDPR framework. Ariana Nexus is monitoring this legislative process. If adopted, Ariana Nexus will update this Cookie Policy and its consent mechanisms to reflect the revised legal framework. Until such changes are finalized and enacted, Ariana Nexus continues to comply with the ePrivacy Directive and GDPR as described in Section 6.1.

7. Data Collected Through Cookies

7.1. The information collected through Cookies may include:

No Sensitive Data: Ariana Nexus does not collect, store, or process Protected Health Information (PHI), Controlled Unclassified Information (CUI), financial account information, Social Security numbers, government identification numbers, or any client engagement data through Cookies or this Website. All such data is processed exclusively within Ariana Nexus's secure enterprise environment under separate contractual agreements, including executed Business Associate Agreements and Data Processing Agreements as applicable.

9. Children

9.1. The Website is not directed to children under the age of thirteen (13). Ariana Nexus does not knowingly use Cookies to collect Personal Information from children under 13, in accordance with the Children's Online Privacy Protection Act (COPPA, 15 U.S.C. § 6501 et seq.) and the FTC's COPPA Rule (16 CFR Part 312), as amended by the January 2025 Final Rule. Ariana Nexus does not engage in targeted advertising directed at children under 13.

9.2. Under the Delaware Personal Data Privacy Act (6 Del. Code Ch. 12D), Ariana Nexus does not use Cookies to process Personal Data of known minors aged 13 to 17 for targeted advertising, sale, or profiling without the minor's consent.

9.3. If Ariana Nexus learns that Cookies have collected Personal Information from a child under 13 without verified parental consent, Ariana Nexus will delete such information promptly.

10. Limitation of Liability

10.1. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ARIANA NEXUS, ITS OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, AGENTS, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATED TO THE USE OF COOKIES ON THE WEBSITE, INCLUDING BUT NOT LIMITED TO: DAMAGES ARISING FROM THE PLACEMENT, FUNCTIONALITY, OR MALFUNCTION OF COOKIES; THE COLLECTION OR PROCESSING OF DATA THROUGH COOKIES; THE ACTIONS OR DATA PRACTICES OF ANY THIRD-PARTY SERVICE PROVIDER; YOUR INABILITY TO ACCESS OR USE THE WEBSITE DUE TO COOKIE SETTINGS; OR ANY UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA BY THIRD PARTIES.

11. Third-Party Disclaimer

11.1. This Website integrates services provided by third parties, including but not limited to Cloudflare, Google, Webflow, Microsoft, and HubSpot. Ariana Nexus does not control and is not responsible for the Cookies set by these third parties, the data they collect, the security of their systems, or their compliance with applicable law.

11.2. Ariana Nexus makes commercially reasonable efforts to select reputable third-party service providers and to enter into appropriate data processing agreements where required. However, Ariana Nexus expressly disclaims all liability for the acts, omissions, errors, data breaches, security failures, or privacy practices of any third party, regardless of whether such third party is identified in this Policy.

11.3. Your interaction with any third-party service is governed by that third party's terms of service and privacy policy. Ariana Nexus is not a party to any agreement between you and a third-party service provider and shall not be held liable for any dispute arising from such interaction.

12. Dispute Resolution

12.1. Governing Law: This Cookie Policy shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, United States, without regard to its conflict of laws principles.

12.2. Jurisdiction and Venue: Any dispute arising out of or relating to this Cookie Policy shall be subject to the exclusive jurisdiction of the state and federal courts located in Arlington County, Virginia, or the United States District Court for the Eastern District of Virginia (Alexandria Division). You irrevocably consent to the personal jurisdiction and venue of these courts.

Ariana Nexus will make reasonable efforts to resolve the matter within thirty (30) business days.

Waiver of Class Action: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE THAT ANY DISPUTE ARISING OUT OF OR RELATING TO THIS COOKIE POLICY SHALL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION.
