The Principle

In August 2021, 76,000 Afghan refugees arrived in the United States in a single month. Federal immigration courts saw asylum case backlogs triple. The Executive Office for Immigration Review reported a critical shortage of qualified interpreters in Dari, Pashto, and other Afghan languages. Cases were delayed. Hearings were continued. Due process was compromised — not because judges lacked the will to hear cases, but because the system lacked the interpreters to make those hearings meaningful.

The justice system operates on a premise that Ariana Nexus understands at a fundamental level: every individual, regardless of language, nationality, or immigration status, has the right to understand and be understood in legal proceedings. When a Pashto-speaking asylum seeker cannot communicate with their attorney, when a Hazaragi-speaking witness cannot convey testimony accurately, when a Dari-speaking detainee cannot comprehend the charges against them — the system fails. Not because of its design, but because of a gap that Ariana Nexus was built to fill.

Ariana Nexus provides court interpretation, legal document translation, law enforcement interpretation, and cultural advisory services for justice system institutions. Every service is governed by the compliance framework described in this document — spanning federal court requirements, CJIS security standards, immigration system regulations, law enforcement language access obligations, and international justice frameworks.

Justice and Public Safety Services Under Compliance Governance

1. Court and Legal Interpretation

Interpretation for immigration proceedings, asylum hearings, criminal proceedings, civil litigation, administrative hearings, and other judicial and quasi-judicial proceedings. Available in all 24 Afghan languages through on-site, telephonic, and video modalities.

Interpreter Qualifications:

Ariana Nexus maintains a roster of interpreters with court and legal interpretation experience, including individuals who have provided interpretation in federal immigration courts, state and local courts, and administrative proceedings. Interpreter qualifications include:

Compliance requirements: DOJ EOIR interpreter standards, 28 CFR Part 68 (Court Interpreter Certification), Executive Order 13166, Title VI of the Civil Rights Act, state court interpreter certification standards, and ABA Standards for Language Access in Courts.

2. Legal Document Translation

Certified translation of court filings, asylum applications (Form I-589), immigration petitions, supporting documentation, legal correspondence, court orders, detention records, country condition reports, and other legal instruments. All translations are certified, with translator attestation of accuracy and completeness.

Compliance requirements: USCIS translation certification requirements (8 CFR § 103.2(b)(3)), federal court translation standards, state court certified translation requirements, and Hague Convention document authentication standards (for international filings).

3. Law Enforcement Interpretation

Interpretation for law enforcement interviews, investigations, witness statements, victim interviews, Miranda rights advisement, community engagement, and crisis response situations involving Afghan-language speakers. Available through on-site, telephonic, and video modalities with rapid-response capability.

Compliance requirements: CJIS Security Policy (for access to criminal justice information), DOJ Language Access Plan requirements, LEP access obligations under Executive Order 13166 and Title VI, Miranda rights interpretation accuracy standards, and victim rights interpretation under the Crime Victims' Rights Act (18 U.S.C. § 3771).

4. Cultural Advisory for Justice System Personnel

Training and advisory services for judges, attorneys, law enforcement officers, corrections personnel, probation officers, and court staff on Afghan cultural protocols relevant to justice system interactions — including gender dynamics in legal settings, tribal and family dispute resolution structures, trauma responses in legal proceedings, cultural factors affecting testimony credibility assessment, and religious considerations in detention and incarceration.

CJIS Security Policy

Overview

The Criminal Justice Information Services (CJIS) Security Policy, published by the FBI CJIS Division, establishes security requirements for any entity that accesses, stores, transmits, or processes Criminal Justice Information (CJI) — including law enforcement records, criminal history data, warrant information, and other sensitive justice system data.

Applicability to Ariana Nexus

Ariana Nexus does not directly access FBI CJIS systems (NCIC, III, NLETS, or state CJIS systems). However, in the course of law enforcement interpretation engagements, Ariana Nexus personnel may be present during interactions where CJI is discussed, displayed, or referenced. Accordingly, Ariana Nexus aligns its security controls with the CJIS Security Policy to ensure readiness for engagements that require CJIS compliance.

CJIS Security Policy Alignment

Policy Area 1: Information Exchange Agreements — Written agreements governing CJI access and security. Aligned — engagement agreements address data handling; CJIS-specific addendum template in development.

Policy Area 2: Security Awareness Training — Personnel with CJI access complete security awareness training. Aligned — security training at onboarding and annually; CJIS-specific module planned.

Executive Office for Immigration Review

The DOJ EOIR operates the U.S. immigration court system, adjudicating removal proceedings, asylum claims, and other immigration matters. EOIR relies heavily on interpreters for proceedings involving limited English proficient respondents.

Immigration and Customs Enforcement (ICE)

ICE detention and enforcement operations involving Afghan-language speakers require interpretation for detainee communications, legal rights advisement, medical screening, and case processing. Ariana Nexus's interpretation services are available for ICE language access requirements, subject to appropriate engagement agreements and security clearances.

DHS Language Access Plan

DHS maintains a Language Access Plan pursuant to Executive Order 13166, requiring meaningful access to DHS programs and activities for LEP individuals. Ariana Nexus's services directly support DHS compliance with its Language Access Plan across CBP, ICE, USCIS, and other DHS components.

Law Enforcement Language Access

Executive Order 13166 and Title VI

Executive Order 13166 requires federal agencies to examine the services they provide, identify any need for services to LEP persons, and develop and implement a system to provide those services. Title VI of the Civil Rights Act of 1964 (42 U.S.C. § 2000d) prohibits discrimination on the basis of national origin, which the DOJ has interpreted to include discrimination against LEP individuals.

The DOJ has issued guidance to federal, state, and local law enforcement agencies on their obligations to provide language access services. Key principles include:

Miranda Rights and Legal Advisement

When law enforcement provides Miranda warnings or other legal advisement to Afghan-language speakers, the accuracy of interpretation directly affects the legal validity of the advisement. An inaccurate or incomplete Miranda interpretation can render a confession inadmissible and compromise an entire investigation.

Ariana Nexus interpreters assigned to law enforcement engagements are trained on the specific requirements of Miranda advisement interpretation, including verbatim accuracy requirements, the prohibition on paraphrasing or summarizing rights, and cultural factors that may affect comprehension (e.g., the concept of the right to silence may have no cultural equivalent in some Afghan contexts, requiring careful explanation beyond literal translation).

Victim and Witness Interpretation

The Crime Victims' Rights Act (18 U.S.C. § 3771) establishes rights for crime victims, including the right to be reasonably heard and the right to full and timely restitution. For Afghan-language-speaking victims and witnesses, these rights can only be exercised through qualified interpretation.

Ariana Nexus provides trauma-informed interpretation for victim and witness interviews, ensuring that interpreters are trained in victim-centered communication, secondary trauma awareness, and the cultural factors that affect how Afghan individuals experience and report victimization.

Court System Compliance

Federal Courts

Federal courts (U.S. District Courts, U.S. Courts of Appeals, U.S. Bankruptcy Courts) use interpreters under the Court Interpreters Act (28 U.S.C. § 1827), which requires the Director of the Administrative Office of the U.S. Courts to prescribe, determine, and certify the qualifications of interpreters. While federal court interpreter certification (28 CFR Part 68) is available only in Spanish, courts appoint "otherwise qualified" interpreters in languages where certification is not available — including all Afghan languages.

Ariana Nexus interpreters assigned to federal court engagements meet the "otherwise qualified" standard through demonstrated linguistic proficiency, legal interpretation training, and courtroom experience.

State court interpreter requirements vary by jurisdiction. Ariana Nexus monitors and complies with the interpreter certification and qualification standards of each state where it provides court interpretation services:

The American Bar Association's Standards for Language Access in Courts provide a comprehensive framework for court language access programs. Ariana Nexus's court interpretation services are designed in alignment with these standards, including qualified interpreter use, interpreter ethics, quality assurance, and language access planning.

Interpreter Ethics and Professional Standards

Code of Professional Conduct

All Ariana Nexus interpreters assigned to justice and public safety engagements adhere to a Code of Professional Conduct aligned with the National Association of Judiciary Interpreters and Translators (NAJIT) Code of Ethics and Professional Responsibilities:

Accuracy: The interpreter renders all statements faithfully and completely, without addition, omission, alteration, or explanation. The interpreter does not summarize, paraphrase, or editorialize.

Impartiality: The interpreter maintains strict neutrality. The interpreter does not counsel, advise, or express personal opinions to any party.

Confidentiality: The interpreter does not disclose any information obtained during interpretation to any person not authorized to receive it. This obligation extends beyond the duration of the engagement.

Role Boundaries: The interpreter functions only as an interpreter. The interpreter does not act as attorney, advocate, counselor, or legal advisor.

Professional Development: Interpreters maintain and develop their professional skills through continuing education, terminology study, and knowledge of legal and procedural developments.

Conflict of Interest: The interpreter discloses any real or perceived conflict of interest before accepting an assignment.

Completeness: The interpreter interprets everything that is said in the proceedings, including statements by judges, attorneys, witnesses, and other participants, regardless of content.

Quality Assurance

International Justice Frameworks

International Criminal Court (ICC)

The ICC (Rome Statute) requires interpretation and translation for proceedings conducted in languages other than the Court's official languages. Ariana Nexus monitors ICC procurement opportunities for Afghan-language interpretation and translation services, particularly for proceedings involving Afghan nationals or Afghanistan-related matters.

International Court of Justice (ICJ)

ICJ proceedings involving Afghan-related disputes may require specialized interpretation and translation. Ariana Nexus's expertise in all 24 Afghan languages positions it for ICJ language services as applicable.

Interpol and Europol

International law enforcement cooperation involving Afghan-language intelligence, evidence, and communications may require qualified interpretation and translation. Ariana Nexus monitors opportunities for language services supporting Interpol and Europol operations, subject to applicable security requirements and engagement agreements.

UN International Residual Mechanism for Criminal Tribunals

The Mechanism, which handles residual functions of the ICTY and ICTR, maintains rosters of qualified interpreters and translators. Ariana Nexus monitors roster registration opportunities for Afghan languages.

Hague Conference on Private International Law

Cross-border legal proceedings under Hague Convention instruments (service of process, evidence, child abduction, adoption) involving Afghan-language documents require certified translation. Ariana Nexus provides Hague-compliant certified translations with apostille-ready attestation.

Data Protection in Justice Engagements

Criminal Justice Information (CJI)

Where Ariana Nexus personnel are exposed to Criminal Justice Information in the course of law enforcement interpretation, CJIS Security Policy requirements apply as described in Section 2 of this document. CJI is classified as Restricted under Ariana Nexus's four-tier data classification framework and is subject to:

Attorney-Client Privileged Information

Interpreters in legal proceedings may be exposed to attorney-client privileged communications. Ariana Nexus treats all attorney-client communications as Confidential or Restricted under its data classification framework. Interpreters are bound by confidentiality obligations and do not disclose privileged communications to any third party.

Immigration Records

Immigration records processed during translation and interpretation engagements (I-589 asylum applications, I-130 petitions, supporting evidence) contain sensitive personal information. These records are classified as Confidential or Restricted and governed by the same data protection controls applied to all sensitive data in the Ariana Nexus environment.

Sensitive Population Protections

Afghan asylum seekers, refugees, and individuals in immigration proceedings are among the most vulnerable populations Ariana Nexus serves. Data relating to these individuals is subject to the heightened protections described in the Privacy & Data Sovereignty — Sensitive Populations & Scholar Safety section of the Trust Center, including enhanced access restrictions, no disclosure to foreign governments, and OFAC compliance screening that protects rather than targets vulnerable individuals.

Alignment with Justice and Public Safety Frameworks

Ariana Nexus's justice and public safety compliance architecture is designed in alignment with the following recognized frameworks and standards:

Limitation of Liability and Disclaimers

Interpretation and Translation Accuracy. Ariana Nexus makes reasonable efforts to ensure the accuracy and completeness of all interpretation and translation services. However, interpretation and translation involve inherent professional judgment, and Ariana Nexus does not warrant that every interpretation or translation will be free from error. Legal professionals retain responsibility for the legal strategy, case management, and outcomes of their cases. Ariana Nexus's liability for interpretation and translation services is limited to the terms of the applicable Engagement Agreement.

No Legal Advice. Ariana Nexus provides interpretation, translation, and cultural advisory services. Ariana Nexus does not provide legal advice, legal representation, or immigration counseling. Individuals seeking legal advice should consult a qualified attorney.

Court and Agency Requirements. Court and agency interpreter requirements vary by jurisdiction and are subject to change. Ariana Nexus monitors applicable requirements and endeavors to meet or exceed them. However, specific qualification requirements may apply to individual proceedings at the discretion of the presiding judge or agency official.

CJIS Compliance. Ariana Nexus's CJIS Security Policy alignment is based on controls currently implemented in its Microsoft 365 environment. Formal CJIS compliance determination is made by the applicable state CJIS Systems Agency (CSA) or the FBI CJIS Division. Ariana Nexus does not self-certify CJIS compliance.

Framework Alignment vs. Certification. Where "aligned" is stated, controls follow the framework but formal certification has not been obtained. Where "compliant" is stated, Ariana Nexus meets the requirement as described.

Roadmap Items. The maturity roadmap reflects current plans as of the Effective Date. Roadmap items are forward-looking statements, not binding commitments.

Limitation of Liability.
